This legal notice identifies the publisher and the host of the Damji platform, accessible via mobile application and website, in accordance with the supplier identification obligations laid down by Law 53-05 (in particular Article 65-3 of the Dahir on obligations and contracts relating to offers made by electronic means) and by Law 31-08 on consumer protection (information on the supplier's identity in distance contracts). It is supplemented by the Terms and Conditions of Use and the Privacy Policy, which form part of it. For any question: support@damjitech.com.

1.1. Publisher of the service

The Damji service is published by Damji, reachable by email at support@damjitech.com. In accordance with Article 29 of Law 31-08 on distance contracts, the postal address of the registered office and the publisher's telephone number, set out in the publisher's identity above, notably enable the consumer to submit complaints. Until these particulars are completed, this legal notice cannot be regarded as definitively published.

At launch, Damji is operated under the self-employed entrepreneur regime (Law 114-13); this information will be updated in the event that a company is formed.

2.2. Publication director

The publication director is the legal representative of the publisher, reachable at support@damjitech.com.

3.3. Hosting

The database and storage infrastructure is provided by Supabase Inc. (cloud infrastructure provider; contact details available at supabase.com). This processing may involve the hosting of data outside Moroccan territory, governed in accordance with Articles 43 and 44 of Law 09-08 and the authorizations of the CNDP, under the conditions specified in the Privacy Policy.

4.4. Nature of the service and Damji's status

Damji operates a technical platform connecting users for the purchase and sale of second-hand or refurbished phones and electronic devices in Morocco, and hosts the content (listings, prices, descriptions, photos, messages) that they publish.

For sales between private individuals, Damji is not a party to the sale contract: it acts as a technical intermediary and host, with no general obligation to monitor third-party content in advance. Its exact role, the scope of the trust services and the limits of its liability are defined in Articles 3, 9 and 14 of the Terms and Conditions of Use.

Where Damji provides, for consideration, services of its own — in particular the subscriptions and promotion options intended for sellers, as well as the direct purchase and subsequent resale of devices under the label "Sold by Damji" — it acts as a professional supplier and these services are governed by dedicated specific conditions, subject to Law 31-08. These services remain free of charge or not activated as long as the corresponding specific conditions and their means of payment are not made available in the application.

5.5. Intellectual property

The platform, its trademarks, logos, interfaces, databases and software are protected and remain the exclusive property of Damji or its partners, in accordance with Law 17-97 on the protection of industrial property and Law 2-00 on copyright and related rights.

Any unauthorized reproduction, representation, extraction or exploitation of all or part of the platform is prohibited. The license granted by users over their own content is governed by Article 16 of the Terms and Conditions of Use.

The platform's database — including the structure, selection, arrangement and organisation of listings, catalogues, models, prices, statistics and aggregated content — benefits from the protection afforded to the database producer by Law 2-00 on copyright and related rights. Without Damji's prior written authorisation, the extraction or re-use of all or a qualitatively or quantitatively substantial part of this database is prohibited, as is the repeated and systematic extraction or re-use of insubstantial parts exceeding normal use. In particular, automated access, indexing, collection, harvesting or copying (robots, harvesting, "scraping") beyond what is permitted for general search engines respecting robots.txt instructions is prohibited, as is any re-use of the content for the purpose of building a competing database or for commercial purposes.

6.6. User content and reporting

Listings, photographs, descriptions and messages are published by users, who are solely responsible for them and warrant that they hold the necessary rights.

Any manifestly unlawful content may be reported to support@damjitech.com, indicating the identity of the reporter, the content concerned and the grounds of unlawfulness. After review, Damji promptly removes or disables access to any manifestly unlawful content brought to its attention, in accordance with Article 18 of the Terms and Conditions of Use.

7.7. Personal data and cookies

The processing of personal data is governed by the Privacy Policy, in accordance with Law 09-08 and the requirements of the CNDP. There you will find the data controller, the purposes, the legal bases, the recipients, the retention periods, the international transfers and your rights, as well as the regime applicable to cookies and local storage.

The processing of personal data carried out by Damji is subject to the prior formalities with the National Commission for the Control of Personal Data Protection (CNDP), under declaration receipt or authorisation No. [CNDP reference to be completed], in accordance with Articles 12, 45 et seq. of Law 09-08. The detail of the purposes, legal bases, recipients, retention periods and international transfers is set out in the Privacy Policy.

8.8. Applicable law and jurisdiction

This legal notice and the use of the platform are governed by Moroccan law.

The Moroccan courts have jurisdiction, in principle those of the publisher's registered office, subject to the public-policy rules protecting consumers under Law 31-08, in particular the consumer's right to bring proceedings before the court of their domicile, which prevail.

9.9. Complaints and contact

For any complaint or question relating to the platform, its content or this notice, please contact us first at support@damjitech.com: we endeavor to provide a response within a reasonable time.

For questions relating to your personal data, you also have the right to refer the matter to the CNDP, under the conditions indicated in the Privacy Policy.

Before any legal action, the parties may resort to conventional mediation, under the conditions provided by Law 08-05 on arbitration and conventional mediation, in order to seek an amicable solution. This recourse is optional and does not deprive the consumer of the right to bring the matter directly before the competent court, in accordance with the public-order rules of Law 31-08. The consumer also retains the option of contacting a consumer-protection association recognised as being of public utility.

10.10. Hypertext links

The platform may contain links to third-party sites or resources, provided as a mere convenience. Damji exercises no control over these sites and disclaims all liability as to their content, availability, privacy policy or use; their consultation is the sole responsibility of the user. The placing of a link pointing to the platform, in particular by framing, embedding or deep-linking that exploits Damji's content, is subject to its prior written authorisation, revocable at any time; such authorisation entails no association, approval, warranty or partnership between Damji and the linking site.
